These Terms of Service ("Terms") are a legal agreement between you and WaiverTrail("WaiverTrail", "we", "us"). By accessing or using the services, websites, APIs, kiosk experiences, and related software we provide (collectively, the "Service"), you agree to these Terms.
You may use the Service only if you can form a binding contract and comply with these Terms and all applicable laws. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.
You are responsible for account credentials, activity under your account, and maintaining security of devices used to access the Service. You must promptly notify us of suspected unauthorized access.
You may use the Service for lawful waiver and consent workflows. You must not misuse the Service, interfere with platform security, transmit malicious code, attempt unauthorized data access, or use the Service in a way that violates law or third-party rights.
You retain ownership of waiver content, templates, and participant data you submit ("Customer Content"). You grant us a limited license to host, process, transmit, and display Customer Content solely to provide and improve the Service, support your account, and meet legal obligations.
Certain features require paid plans or may be subject to usage limits. Pricing, billing cycles, and plan entitlements are described in-product or in an executed order form. You are responsible for applicable taxes unless otherwise stated.
The Service may integrate with third-party providers (for example, messaging, payments, or identity services). Your use of those services may be governed by the provider's terms, and we are not responsible for third-party systems outside our reasonable control.
We and our licensors own all rights in the Service, including software, trademarks, and documentation, except for Customer Content. No rights are granted except as expressly stated in these Terms.
Current operational status and posted incidents are published at our status page. Standard self-serve service is provided without guaranteed uptime credits. Paid SLA terms (including monthly availability targets and service-credit remedies) apply only where explicitly included in your signed order form or enterprise addendum.
We may modify features, provided such changes do not materially reduce core contracted functionality without notice where required.
We may suspend or terminate access for violations of these Terms, legal risk, security threats, or non-payment. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenues, or data, arising from use of the Service.
You agree to defend, indemnify, and hold harmless WaiverTrail and its affiliates from claims arising from your misuse of the Service, breach of these Terms, or violation of applicable law.
These Terms are governed by applicable law in the jurisdiction identified in your order form or, if none is specified, the jurisdiction where WaiverTrail is organized. Disputes will be resolved in competent courts of that jurisdiction unless otherwise required by law.
We may update these Terms from time to time. Material updates will be posted on this page with a new "Last updated" date and, where appropriate, communicated in-product or by email.
